Terms of Service

These Terms of Service ("Terms") govern your access to and use of calmerity.com (the "Site") and any purchase you make from us. By placing an order or using the Site, you agree to these Terms. Please read them carefully.

1. Who we are

The Site is operated by CHRISTEAUFF - RENOVATION DE SALLES DE BAIN, a French limited liability company (EURL) registered with the Toulouse Trade and Companies Register under number 849 859 145, VAT number FR56849859145, with its registered office at 60 Chemin du Ruisseau de Fontbazi, 31450 Donneville, France. Calmerity is a trading name of that company.

You can reach us by email at support@calmerity.com. We provide customer support by email only. We aim to reply within two business days.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to order from us. By placing an order, you confirm that you meet these conditions and that the information you provide is accurate and complete.

3. Products

We make every effort to display our products accurately, including colors, dimensions and features. Screens vary, so slight differences in appearance are possible. Product packaging and accessories may change without notice.

Our products are consumer wellness and relaxation devices. They are not medical devices. They are not intended to diagnose, treat, cure or prevent any disease or medical condition. Nothing on this Site is medical advice. If you have a medical condition, are pregnant, wear a pacemaker or other implanted device, or have any doubt about whether a product is suitable for you, consult a qualified healthcare professional before use. Always follow the instructions supplied with the product.

4. Orders and acceptance

Your order is an offer to buy. We accept it when we send you an order confirmation email. If we cannot fulfil an order, we will tell you and refund any amount charged.

We may refuse or cancel an order at our discretion, including where a product is unavailable, where there is an error in the price or description, or where we suspect fraud or a breach of these Terms.

5. Prices and payment

All prices are shown in US dollars and exclude any applicable taxes and duties unless stated otherwise at checkout. Prices may change at any time, but changes will not affect orders we have already confirmed.

Payment is taken at the time of purchase. We accept the payment methods displayed at checkout. Your card statement will show CALMERITY.

If a product is listed at an incorrect price due to an obvious error, we may cancel the order and refund you in full, even after confirmation.

6. Shipping and delivery

We ship within the United States. Delivery times and conditions are set out in our Shipping Policy, which forms part of these Terms. Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery.

Please check your shipping address carefully at checkout. We are not responsible for orders delivered to an address entered incorrectly.

7. Returns and refunds

Our Refund and Return Policy forms part of these Terms and sets out your rights to return a product and obtain a refund, including our 60-day risk-free trial.

8. Intellectual property

All content on the Site, including text, images, video, graphics, logos and the Calmerity name, is owned by us or licensed to us and is protected by intellectual property law. You may not copy, reproduce, distribute or create derivative works from it without our prior written permission.

9. Acceptable use

You agree not to use the Site for any unlawful purpose, not to attempt to gain unauthorized access to it, not to interfere with its operation, and not to use it in any way that could damage or impair it or another user's use of it.

10. Reviews and submissions

If you submit a review, comment or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business. You confirm that the content is your own, accurate, and does not infringe anyone's rights. We may remove content at our discretion.

11. Disclaimers

The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure or error-free.

Nothing in these Terms excludes or limits any right you have under mandatory consumer protection law.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue or data, arising from your use of the Site or our products. Our total liability in connection with any order will not exceed the amount you paid for that order.

13. Indemnity

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

14. Privacy

Our Privacy Policy explains how we collect and process your personal information and forms part of these Terms.

15. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order is the version that applies to that order. We will post any revised version on this page with an updated date.

16. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

17. Governing law

These Terms are governed by French law. Any dispute will be subject to the exclusive jurisdiction of the competent courts of France, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
